The customer warrants that any subject matter submitted to Matthew Keeler Artist for reproduction is not copyrighted by a third party. The customer also recognizes that because matter does not have to bear a copyright notice in order to be protected by copyright law, absence of such notice does not necessarily assure a right to reproduce. The customer further warrants that no copyright notice has been removed from any material used in preparing the subject matter for reproduction. To support these warranties, the customer agrees to indemnify Matthew Keeler Artist harmless for all liability, damages, and legal fees that may be incurred in any legal action connected with copyright infringement involving the work produced or provided.

Privacy Policy

If you purchase goods through the website Matthew Keeler Artist may require you to provide your name, address, email address, credit card numbers and delivery information or other details ("customer information"). This information will only be used by Matthew Keeler Artist for the purpose of meeting your needs, to process, fulfill and follow up on orders, reply to email, return information you request via post or email. The personal information held is stored in a secure manner and is never disclosed to any other parties or organizations.

Children's Privacy

Matthew Keeler Artist does not sell products for purchase by children. If you are under 18, you may use the website only with the involvement of a parent or guardian.

Payment

Payment may be made by credit card, cheque, bankers draft, bank transfer or cash. All payments are taken in UK Pounds Sterling ( GBP ). Works will only be released after funds have cleared.

Retention of Title

Title of all works purchased from Matthew Keeler Artist shall not pass to the buyer until the invoiced amount has been paid in full.

Website images colour proofing

Due to photographic and monitor variations, Matthew Keeler Artist can not guarantee that the images of work displayed on this website are a true representation of those works. The actual artwork colours may not match the colours on your screen. Customers are advised to view all works prior to purchase, either at the artists studio by appointment or at the clients home by arrangement.

Product Information

Prices of goods displayed on the website are current at the time of display. Every reasonable care is taken to ensure the accuracy of all products listed. However, no liability is accepted for any errors in pricing and description. Pricing and stock availability is subject to change anytime without notice. Matthew Keeler Artist does not guarantee that the art on the website will always be available, nor can Matthew Keeler Artist guarantee to provide an error free service. All artwork is sold ' as is' without warranty of any kind. Matthew Keeler Artist reserves the right not to sell an item to an individual or group at any given time, even if payment has been made. In such instances a full refund will be processed promptly. In all other instances a refund will be given strictly at the discretion of Matthew Keeler Artist.

Placing and Accepting Orders

Purchase and commission orders will be confirmed by email or post. Commissions are placed and confirmed with an agreed, non-refundable deposit. Orders and commissions will be completed as quickly as possible. Works purchased will not be released until paid in full and after funds have cleared. Credit cards will only be charged after your approval of the total cost, which includes the cost of the artwork, all shipping, transit insurance and handling costs. Purchasers are responsible for any and all local customs, taxes and import duties that may be levied. Payments on commissioned work will be in installments during the course of the work in accordance with the Artists normal procedure.

Prices VAT & Taxes

At the current time VAT is not applicable until further notice. The price does not include framing. Framing can be arranged at additional cost. The price does not include delivery, shipping and transit insurance. These can be arranged at additional cost. Purchasers are responsible for any and all local customs, taxes and import duties that may be levied.

Cancellation

If a commissioned work is cancelled before it is completed, you will be required to pay such sum ( taking into account payments already made ) as will reward Matthew Keeler Artist for the work completed to date of cancellation and all expenses incurred by Matthew Keeler Artist in connection with the commissioned work. The unfinished work will remain the property of Matthew Keeler Artist.

Delivery and collection

Your order will be fulfilled as soon as is possible. You will be informed of any delays and advised of the delivery or collection date. If delivering or shipping to you is required, Matthew Keeler Artist will provide you with a delivery or shipping quote to be agreed by you, prior to dispatch. This price will include packing and transit insurance. Risk in the goods passes on delivery to the address stated in your order or upon collection from the Artists studio.

Virus Warning

All care is taken to ensure that the website and data transmissions are virus free. However, it is your responsibility to scan any such data for viruses.

Rule of Law

English law applies to the interpretation of these Conditions
